This document governs the use of the property, services, website, and event bookings at The Legacy Estate (“The Legacy Estate,” “we,” “us,” or “our”). By accessing our website, making an inquiry, booking a stay or event, or entering the property, you agree to be bound by the terms set out below.

1. Property Information

2. Acceptance of Terms

By booking a stay or event, submitting payment, signing any agreement, or entering the property, you acknowledge, accept, and agree to be legally bound by these Privacy Policy & Terms and Conditions in full.

If you do not agree to these terms, you must not book, attend, or use the property or services of The Legacy Estate.

3. Privacy Policy

3.1 Information We Collect

We may collect:

• Names, email addresses, phone numbers

• Booking, billing, and payment details

• Event details and communications

• Website usage or technical data (if applicable)

3.2 Use of Information

We use collected information to:

• Process bookings and payments

• Communicate regarding stays or events

• Provide customer support

• Comply with legal and business obligations

3.3 Sharing of Information

We do not sell personal information. Information may only be shared:

• With service providers necessary to operate bookings or payments

• Where legally required

3.4 Data Security & Retention

We take reasonable steps to protect personal information and retain it only as long as necessary for legal, operational, or business purposes.

4. Bookings, Payments & Cancellations

• All bookings are subject to availability and confirmation

• Payment terms, deposits, and cancellation policies are disclosed at booking

• Failure to comply with payment requirements may result in cancellation without liability to The Legacy Estate

5. Use of Property

Guests and clients agree to:

• Use the property responsibly and lawfully

• Follow all house rules, safety guidelines, and instructions

• Respect occupancy limits, noise restrictions, and local laws

We reserve the right to terminate a stay or event without refund for serious violations.

6. Events, Weddings & Private Functions

6.1 Event Approval

Weddings, corporate events, private events, retreats, celebrations, and gatherings (“Events”) require prior approval and may be subject to additional agreements, fees, deposits, and rules.

The individual or entity booking the Event (“Client”) is the primary responsible party.

6.2 Client Responsibility

The Client is fully responsible for:

• All guests, invitees, vendors, contractors, and service providers

• Their conduct, actions, and compliance with these terms

• Any damages, incidents, violations, or losses arising from the Event

7. Restricted Areas & Private Property

7.1 Upstairs Level – Private Area

All guests, vendors, and attendees acknowledge and agree that the upstairs level of the property is private property and is strictly off-limits before, during, and after any Event unless explicitly declared in writing by The Legacy Estate as accessible.

7.2 Unauthorized Access

Unauthorized entry into restricted or private areas may result in:

• Immediate removal of individuals

• Termination of the Event without refund

• Additional charges for damages, security, or cleaning

The Client is fully responsible for ensuring compliance.

8. Assumption of Risk

The Client and all attendees acknowledge that use of the property involves inherent risks, including but not limited to:

• Slips, trips, or falls

• Outdoor terrain and weather conditions

• Physical activity, dancing, or movement

• Temporary installations, décor, or equipment

All parties voluntarily assume all risks associated with being on the property.

9. Limitation of Liability

To the fullest extent permitted by law, The Legacy Estate shall not be liable for:

• Any injury, illness, accident, incident, or death

• Loss, theft, or damage to personal property

• Acts or omissions of guests, vendors, or third parties

This applies regardless of where on the property the incident occurs, including restricted or private areas.

10. Hold Harmless & Indemnification

The Client agrees to indemnify, defend, and hold harmless The Legacy Estate, its owners, employees, agents, and affiliates from any claims, damages, liabilities, losses, costs, or legal expenses arising from:

• The Event

• The actions, negligence, or misconduct of the Client, guests, vendors, or contractors

• Any breach of these Terms and Conditions

This obligation survives the conclusion of the Event.

11. Waiver of Litigation & Legal Claims

By booking and/or attending an Event, the Client knowingly and voluntarily waives any right to bring legal action, lawsuits, or claims against The Legacy Estate for:

• Personal injury

• Property damage

• Accidents or incidents occurring before, during, or after the Event

This waiver extends to all Event attendees, guests, and vendors.

12. Negligence of Client or Guests

The Client agrees they are fully responsible for all actions, incidents, injuries, damages, or losses caused by:

• Their own negligence

• The negligence or misconduct of their guests, invitees, vendors, or contractors

The Legacy Estate bears no responsibility for such acts or outcomes.

13. Damage to Property, Grounds, Vehicles & Equipment

The Client and all Event attendees acknowledge and agree that they are jointly and severally responsible for any and all damage, whether intentional or accidental, caused to:

• The residence and buildings

• The grounds, landscaping, lawns, gardens, and outdoor areas

• Any vehicles located on the property

• Any equipment, furnishings, fixtures, or assets belonging to The Legacy Estate

The Client authorizes The Legacy Estate to charge repair, replacement, cleaning, or restoration costs to the security deposit or payment method on file. If costs exceed the deposit, the Client remains fully responsible for the balance.

14. Insurance Requirement

For certain Events, the Client may be required to obtain event liability insurance naming The Legacy Estate as an additional insured. Failure to provide required insurance may result in cancellation.

15. Damage & Security Deposits

Security deposits may be used to cover damages, excessive cleaning, repairs, or losses. Use of the deposit does not limit the Client’s financial responsibility.

16. Cancelation Policy

We require a 50% security deposit for all event bookings, and the balance is required no later than 48 hours before your event. Your deposit is fully refundable up to 2 weeks before the event. and partially refundable up to 1 week before the event. All cancellations made within 1 week of your event are considered non-refundable for the deposit.

17. Intellectual Property

All branding, content, images, and materials associated with The Legacy Estate are the property of The Legacy Estate and may not be used without written consent.

18. Governing Law

These Terms and Conditions are governed by the laws of the Province of British Columbia and the laws of Canada.

19. Modifications to Terms

We reserve the right to update or modify these terms at any time. Continued use of the property or services constitutes acceptance of the revised terms.
